What Happened at Camp Lejeune?
Camp Lejeune, located in Jacksonville, North Carolina, is believed to have contaminated drinking water which exposed unsuspecting active duty and National Guard service members who lived there to consume toxic, cancer causing substances for many years. The United States Department of Veterans Affairs declared in 2015 that certain diseases and illnesses reported by former Camp Lejeune residents while serving military duty were eligible to receive healthcare benefits.
The VA Announced New Rules Which Clarifies the Disability Benefits Set Aside for Qualified Service Members
On January 13, 2017, the United States Department of Veterans Affairs announced a new rule that was designed to make the process of filing for VA Disability quicker and easier for those military members injured due to Camp Lejeune’s water contamination. This rule was made effective starting on March 14, 2017.
Diseases That Qualify for VA Disability Compensation
Since the United States Department of Veterans Affairs has created a presumption in which particular conditions have been identified and linked to a particular place and time, there is no requirement for the disabled veteran to prove the disease or injury is “service-related.” To apply for VA Disability Compensation, the applicant only needs to demonstrate that they were assigned to Camp Lejeune, stayed at the base for a period of 30 days or longer and has one of the following disabling conditions:
- Adult Leukemia
- Aplastic Anemia
- Bladder, Kidney or Liver Cancer
- Multiple Myeloma
- Myelodysplastic Syndrome(s)
- Non-Hodgkin’s Lymphoma
- Parkinson’s Disease
The VA expanded their statutory definition of a “veteran” in order to grant all service members affected by the Camp Lejeune water contamination event to receive VA Disability Benefits. This means that active-duty service members including Reservists, National Guard service members, and active duty service members may qualify.
